The Concept of Legal Narcissism
Legal Narcissism is a theoretical framework developed for the analysis of legal-institutional phenomena related to the exercise of power, legal interpretation, and the limits of authority. The theory examines situations in which the interpretive function progressively assumes a more central role in determining the content, scope, and limits of legal norms themselves.
Legal-Institutional Nature
The theory does not use the term “narcissism” as a clinical or psychological diagnosis of individuals. Rather, the term operates at the conceptual and institutional level, as an analytical instrument for examining structures of power in which authority progressively assumes a central position in the production of legal meaning.
Structural Elements
The Theory of Legal Narcissism is organized around the relationship among several elements: legal norms, power, authority, interpretation, legitimacy, and institutional limits. The interaction among these elements makes it possible to examine how particular legal structures may modify, expand, or restrict the scope of action available to interpretive authority.
Interpretive Superiority
One of the concepts examined by the theory is the phenomenon of interpretive superiority, characterized by the progressive attribution to an authority of a determinative position in defining the meaning and scope of legal norms, including those intended to establish limits on the exercise of that authority’s own power.
The Paradox of Limiting Power
A central problem therefore emerges: if law establishes limits on power, but the concrete meaning of those limits depends upon interpretation by institutions vested with authority, it becomes necessary to examine which legal and institutional mechanisms are capable of preserving the effectiveness of those limits.
Development of the Theory
Legal Narcissism develops from this problem to construct an analytical framework capable of identifying processes of interpretive expansion, decisional concentration, and transformation in the relationship between legal norms and authority. The theory is developed systematically across the different editions of Legal Narcissism.
