A New Legal-Institutional Theory of the Exercise of Power<\/h2>\n\n\n\n

Legal Narcissism is a legal-institutional theory devoted to investigating the processes through which agents, bodies, and institutions vested with authority may progressively expand their role in defining the very legal limits that constrain the exercise of power.<\/p>\n\n\n\n

The theory begins with the centrality of legal norms as instruments for limiting power and examines the tensions that arise when legal interpretation ceases to operate exclusively as a mechanism for applying, concretizing, and developing the law and begins to participate, to varying degrees, in redefining the limits previously established by the legal order itself.<\/p>\n\n\n\n

Its subject lies particularly within the fields of Constitutional Law, Legal Theory, and institutional analysis, engaging with the history of limitations on power, the separation of powers, the Rule of Law, legal hermeneutics, and mechanisms for controlling authority.<\/p>\n\n\n\n

The Problem Under Investigation<\/h2>\n\n\n\n

Every constitutional order faces a fundamental question: who controls those who exercise power, and who establishes the limits applicable to those vested with authority to interpret the rules that constrain that very power?<\/p>\n\n\n\n

Legal Narcissism investigates this problem through the relationship among legal norms, interpretation, and authority. Its focus is not on criticizing a particular institution, political system, or specific individual, but on identifying institutional mechanisms capable of emerging whenever the interpreter progressively participates in determining the extent of its own authority.<\/p>\n\n\n\n

The Theoretical Proposal<\/h2>\n\n\n\n

The theory proposes Legal Narcissism as an analytical category for examining the institutional exercise of power, seeking to identify situations in which interpretive authority progressively assumes a central role in determining the meaning, scope, and limits of the very norms intended to govern its conduct.<\/p>\n\n\n\n

The concept does not constitute a psychological or clinical diagnosis of individuals. It is a theoretical construct of a legal and institutional nature, directed toward the analysis of relationships among authority, interpretation, self-restraint, and normative limitation.<\/p>\n\n\n\n
